If I didnt register the deposit with a scheme, but let the tenants use it as their last months rent, can they still take me to court, even though they have had their money back in effect?

My friend was taken to court by landlord for all of her £5000 deposit for damages, (she was only in the property 5 months) the judge said it should be no more than £1000 and referred them back to the the Deposit resolution to sort it out. 6 months later the Deposit resolution could not decide either, so 2 years on she is still with out her deposit. These schemes are a sham.

[...] After explaining some of the legal obligations of landlords, such as the new Energy Efficiency Certificates required on all rental properties by 1st October 2008, Jim made it very clear about his view on the tenancy deposit scheme and his approach of opting out by not taking a deposit, but instead charging a non refundable admin fee instead. More in his article here [...]

A thorough review of the tenancy deposit issues.
I particularly liked the way that the non-legal elements were discussed as well as the legal (eg 1. deposits require the tenant to have some degree of fund management, which gives the landlord an idea of their suitability and 2. The psychological advantage of a deposit encouraging tenants to ensure they care for the property, to some extent)
Useful information on how to deal with tenancy deposits.
An article certainly worth reading by all landlords.
